Dear Afshari Estates Residents,

Maintaining the quality of life in our neighborhood is the primary concern of our Homeowners Association (HOA) Executive Board.  As a resident, you undoubtedly share our desire to continue to build our subdivision’s strength and make improvements where necessary. Therefore, we are excited to share the following updates which include some mandatory changes effective immediately. 

First, to address ongoing concerns previously brought to the attention of the Board, there are numerous Subdivision Rules & Restrictions which require reinforcement and mandatory adherence. These mandates were reapproved by the HOA BOARD on March 5, 2024, and become EFFECTIVE IMMEDIATELYBe advised, violations can result in police and/or other appropriate authorities being contacted which may result in citations and/or fines being issued to violators. 

 The Rules/Restrictions going into effective immediately are listed below and are based upon guidance from St. Louis County and the state of Missouri:  

  • Vehicles/Parking:    Ordinance SLC RO 1207.040

a) Parking Violations: Residents should NOT park any type of vehicle in a manner that interferes with the normal flow of traffic on streets or at circle/island areas.

b)  Junked Motor Vehicles/Unlicensed /Improperly licensed Vehicles:   Residents may not operate or park an unlicensed or junked vehicle on any roadway.  Residents may not park or store an unlicensed or junked vehicle or parts of a junked vehicle on their property for longer than seventy-two (72) hours unless the vehicle is enclosed within a building.

d) All-Terrain Vehicles (ATVs):     Ordinance: SLCRO 716.078

It is unlawful to operate an all-terrain vehicle (ATV) within one hundred (100) feet of another residential property and/or on a public paved road or sidewalk. An all-terrain vehicle is defined as any motorized vehicle with three (3) wheels or four (4) wheels designed for use off paved roads.

  • Fireworks (Prohibited):     Ordinance SLCRO 810.020

It is against the law for any person, firm, or corporation to sell, possess, offer for sale, expose for sale, give, use, discharge or explode fireworks within St. Louis County.

  • Noise/Nuisance/Disturbance of the Peace:   Ordinance SLCRO 716.060   

It is unlawful to play any radio, musical instrument/device, television, etc. speak, shout, sing, etc. or create any disturbance at a volume that is plainly audible more than fifty (50) feet away that disturbs the peace of another person.

  • Outdoor Sports Equipment Restrictions:    Ordinance SLCRO 1218.130  

Basketball hoops, playground or sports-related apparatus or similar objects are prohibited on or within a public roadway or sidewalk. A designated representative of the Department of Transportation and Public Works or any St. Louis County Police officer may remove these objects from a roadway or sidewalk.

  • Pet Ownership Regulations and Restrictions are, but not limited to:

a) When outside of the house, pets must always be kept on a leash, be under proper control and accompanied by a responsible individual. 

b) Tethering pets outside for any purpose should not exceed 30 minutes and requires proper supervision.  

c) Residents are not allowed to keep aggressive breeds or pets displaying aggressive behavior. No single pet should exceed the weight limit of 50 pounds.

d) Pet owners are responsible for the immediate and sanitary disposal of pet waste.

If pets create a nuisance (barking, unsupervised, aggressive, bites etc.) they should be reported to St. Louis County Animal Control.    Ordinance SLCRO 611.200

  • Vacant Properties Concerns/Property Violations

a) If a property has been vacant for ninety (90) days and presents a public nuisance on the property, it will be subject to monthly inspections by the Department of Transportation and Public Works and Public Works Problem Properties Unit until the situation is resolved. The cost of these inspections will be billed to the owner as a special tax bill.

a) Tall Grass & Weeds:  In St. Louis County, grass and weeds on residential property cannot be taller than eight (8) inches. If a violation notice is issued by St. Louis County, the property owner must cut the grass/weeds within seven (7) days of receiving the notice. If the problem is not taken care of by the compliance date on the violation notice, the grass will be cut by a St. Louis County contractor and billed to the property owner in the form of a Special Tax Bill.    Ordinance SLCRO Chapter 619

b) Litter /Trash Accumulation in Yards: Yard areas should be clean and well maintained with no accumulation of litter, used appliances, broken or discarded furniture, parts of derelict cars or trucks or other material. Expect more information to be forthcoming as we work to address additional issues, including but not limited to:

  • Tenant/Occupancy Concerns (Tenant registration, Occupancy/Re-occupancy Permits, Occupancy Limitations, Sublet restrictions, etc.) 
  • Increasing police patrols throughout the subdivision
  • Establishing a Neighborhood Watch program
  • Installation of speed bumps
  • Researching state and/or local grants available (e.g. beautification programs, solar power, etc.)

Additionally, we are happy to announce that we are currently working to complete the development of a community website which will provide convenient access to pertinent information. Once available, you will be able to access the complete version of the current Subdivision Covenants, Rules & Restrictions, subdivision Bylaws, emergency contact information and have access to electronic payment options for annual assessments and more.  We will continue to provide updates on ongoing projects via additional community newsletters.
